These Terms of Service ("Terms") govern your use of the Earth Tab website and any services provided by Earth Tab ("we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
Agreement to Terms
By accessing earthtab.com or entering into a service agreement with Earth Tab, you confirm that you are at least 18 years old and have the legal authority to enter into a binding agreement. These Terms apply to all visitors, clients, and anyone who accesses or uses our website and services.
Services
Earth Tab is a digital agency based in Southern California. We provide the following services:
- Custom web design and development
- Digital marketing, including Google Ads, Meta Ads, and email campaigns
- Search engine optimization (SEO)
- AI integration and custom AI assistants
- Business application development
- Credit card processing setup and management
The specific scope, deliverables, and timeline for each project will be outlined in a separate proposal or service agreement between Earth Tab and the client.
Quotes & Pricing
All quotes and proposals provided by Earth Tab are valid for 30 days from the date they are issued, unless otherwise stated in writing. After 30 days, pricing is subject to change based on current availability and project scope.
Prices are subject to change at any time for new projects. Existing agreements will be honored at the rate specified in the signed proposal or contract. Payment terms, including deposit requirements and milestone payments, will be outlined in your individual service agreement.
Intellectual Property
Upon full payment for a completed project, the client owns the final deliverables, including website code, design files, and content created specifically for the project. This does not include any proprietary tools, frameworks, or templates that Earth Tab uses across multiple projects.
Earth Tab retains the right to showcase completed work in our portfolio, case studies, and marketing materials, unless both parties agree otherwise in writing prior to the start of the project.
Any pre-existing intellectual property that a client provides to Earth Tab (logos, brand assets, copy, images) remains the property of the client. Earth Tab will only use these materials for the purpose of delivering the agreed-upon services.
Client Responsibilities
To keep projects moving smoothly, clients agree to:
- Provide all requested content, images, brand guidelines, and materials in a timely manner
- Respond to feedback requests and approve milestones within a reasonable timeframe
- Ensure they have the legal right to use all materials provided to Earth Tab, including logos, photos, text, and any third-party content
- Communicate project changes or new requirements as early as possible
Delays caused by late or missing client materials may extend project timelines. Significant scope changes requested after a project has begun may require a revised quote.
Care Plan Terms
Earth Tab offers monthly Care Plan subscriptions that include ongoing website maintenance, updates, hosting, and support. Care Plan details and pricing are outlined in your service agreement.
- Care Plans are billed on a monthly basis
- You may cancel your Care Plan at any time with 30 days written notice
- Upon cancellation, services included in the Care Plan (hosting, maintenance, AI assistant access) will continue through the end of the current billing period
- After cancellation, we will provide any files or assets needed for you to transition to another provider
Website Hosting
Website hosting is included as part of the Earth Tab Care Plan. Earth Tab manages hosting infrastructure on behalf of clients, and we aim for 99.9% uptime. However, we cannot guarantee uninterrupted service due to factors beyond our control, including third-party infrastructure outages, DNS propagation, or force majeure events.
If you cancel your Care Plan, your website hosting will end at the conclusion of your final billing period. We will work with you to ensure a smooth transition to your new hosting provider.
AI Assistant Terms
Clients on an active Care Plan may receive access to a custom AI assistant delivered through Telegram. These AI assistants are designed to help with business operations, customer inquiries, and internal workflows.
- AI assistants are provided for legitimate business use only
- Earth Tab is not liable for decisions made based on AI-generated responses
- AI assistants may occasionally produce inaccurate or incomplete information — they are tools to assist, not replace, professional judgment
- Access to AI assistants is tied to your active Care Plan and will end upon cancellation
Limitation of Liability
Earth Tab provides our website and services on an "as is" basis. To the fullest extent permitted by law, Earth Tab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of data, or business interruption, arising out of or related to your use of our website or services.
Our total liability for any claim arising from our services shall not exceed the total amount you paid to Earth Tab for the specific service giving rise to the claim during the twelve (12) months preceding the event.
Termination
Either party may terminate a service agreement with written notice as specified in the individual contract. Earth Tab reserves the right to suspend or terminate services if a client violates these Terms, fails to make payment within the agreed timeframe, or engages in conduct that is abusive, fraudulent, or harmful to our team or other clients.
Upon termination, all outstanding invoices become immediately due. Earth Tab will deliver any completed work up to the point of termination, and the client will receive any files or assets they are entitled to under the agreement.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the courts located in the State of California.
